The membership of Clinikk and the use of services of Clinikk are available only to persons who are Majors (persons above the age of 18 years) under the Indian Law and persons who are capable of forming a valid contract under the Indian Contract Act, 1872. In the case where the services of Clinikk are to be availed for a minor, the terms and conditions are to be complied with by the parent/guardian of such minor. Clinikk reserves the right to terminate your membership if it is discovered that you are a minor or a person incompetent to contract under the Indian Contract Act, 1872. This document shall be deemed to be a binding contract between you and Clinikk and shall be enforced against you. If it is found that any of the aforesaid criteria is not met or violated, Clinikk reserves the right to grant or refuse access to the website and services offered thereunder to its new/existing users.
Access to the website is free and does not require disclosure of any information. However, to us the services of the website, you may be required to furnish certain information. Where logging in with a user Id and Password is required, it shall be your sole responsibility to maintain the confidentiality of your username, password and other personal and sensitive data. In case of loss of confidential and personal information or any breach of security of your account information, inform us by sending a mail to support@clinikk.com In the event where you wish to avail the services without creating an account, you may obtain the services through the website by submitting contact details like your mailing id and contact number for Clinikk representatives to call and book appointments. However, such calls may be recorded and stored in Clinikk’s servers. Such call back services are to be used only for appointment and booking purpose and not for any consultation on any health issues. You shall not have more than one active account on the website. Further, you are barred from selling or otherwise transferring your account to another person.

Clinikk reserves the right to indefinitely suspend or terminate the User account or block access to the website in the event Clinikk has reasonable grounds to suspect that the information furnished by you is false, inaccurate, inadequate and incomplete. If at any point in time, it is found out that you have provided false, inaccurate, inadequate, fraudulent and incomplete information, Clinikk reserves the right to deny access to the website and services offered there under to its new/existing users and you shall be liable to indemnify any loss or damage caused to Clinikk because of such false, inaccurate, inadequate, incomplete and fraudulent information adversely affecting Clinikk or its users.

Clinikk enables the medical practitioners/healthcare providers to connect with the patients and respond to the questions of the users posted through their account. The medical practitioners/health care providers represent and warrant that:
He/she is a qualified medical practitioner/health care provider recognized in India
Has all the necessary qualification, license, and experience to practice as a medical practitioner/health care provider in India
Will take all reasonable measures to keep the license in force/ renewal of license as and when applicable
He/she will provide complete, true and correct information to Clinikk about their qualification, practice and other credentials
He/she will ensure utmost care, caution, skill, and ability while treating patients and providing health care services
He/she will abide by the medical regulations set by the concerned authorities from time to time
He/she will not assign their duties and responsibilities to any other person while treating a patient of Clinikk, whether under supervision or not.
He/she will not solicit the patients of Clinikk.
He/she agrees and accepts all responsibility and liability for the services rendered and agrees to indemnify Clinikk for any claim, loss or damage that may be suffered by Clinikk because of the services of the medical practitioner/health care provider.
He/she agrees and accepts to maintain the highest level of confidentiality of all information provided by the patient at all instances. The medical practitioner/health care provider agrees not to disclose any of the personal and sensitive information about the patient to anyone except required by law to do so.
The medical practitioner/health care provider shall indemnify and hold Clinikk harmless from and all and any demands, liabilities, losses, costs, claims asserted and expenses including attorney’s fees, against Clinikk arising out of any default, breach, non-performance, misconduct, non-observance or omission of any terms of this Policy.
Clinikk reserves the right to terminate the account of any medical practitioner/healthcare provider if it is found that:
The medical practitioner/health care provider as breached any provisions of this Policy or Privacy Policy;
The medical practitioner/health care provider has breached or violated any provision of the Laws;
The information provided by the medical practitioner/health care provider is found to be incorrect, incomplete, false or the authenticity of which could not be verified by Clinikk;
Neither we nor any of our licensors or service providers make any kind of warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. Clinikk does not make any representation or warranty, express or implied, about the services or any of the content of the website. Clinikk disclaims responsibility for all and any damages that due to the viruses, worms, bugs that may infect the user’s computing devices because of the user’s use, browsing of the website and downloading any images, files from the website. Any negligence or misconduct of the medical practitioner;
Wrong prescription or treatment protocol set by the medical practitioner. Although sufficient care will be taken by the Clinikk’s team to ensure the appropriate treatment and prescription, Clinikk will not be responsible for the breach of professional standards by the medical practitioner/health care provider;The quality of treatment given by the medical practitioner/health care provider;
Cancellation or rescheduling of appointment either by the patient or by the medical practitioner/health care provider;
Any medical consequences subsequent to the use of services under Clinikk. In addition to the above, Clinikk or any of its officers, administrators, directors, employees, agent or service providers shall not be liable, directly or indirectly, for any direct, indirect, remote or consequential damage, loss or claim arising out of the user’s use of the website or availing of services thereunder and for any information or content hosted, displayed, uploaded, modified, published, transmitted, updated or shared on/through the website.
There could be content or information including, images, text, infographics, videos, guidance, suggestions, opinions, procedures on the website as may be provided by the medical practitioners/health care providers. Such information is only for the reference of the patient and not to be considered as prescription. Clinikk does not warrant the accuracy, authenticity, and correctness of such information. It is suggested that the patient consults the medical practitioners/health care in case of any medical requirement. Under no circumstance should such information be used as emergency health care.

Clinikk believes in helping its customers as far as possible and has, therefore, a liberal cancellation policy. Under this policy: An appointment booked shall be considered as cancelled if -
The appointment with a medical practitioner/health care provider is terminated; or
The request is made to consult another medical practitioner or health buddy.
Cancellations will be considered only if the request is made within 12 hours before the time scheduled for an appointment. Cancellation and Refund of fees or charges will be strictly governed by the Company Refund Policy of the company given here Cancellation Policy (give a hyperlink) informed and declared from time to time.

Health Card is a Privilege Card to avail the services, benefits, offers and discounts on Clinikk and cannot be used as a Cash Card or Bank Card.

The Health Card can be activated by logging into clinikk.com and filling the form.
The Health Card may be availed either for oneself and/or for any of the family members.
The Health Card Benefits can be availed by logging into the website and choosing from the services of Clinikk.
The usage of the Health Card affirms that the Card Holder has read and understood all the terms and conditions applicable to this Health Card and further agrees to abide by the same at all instances.
Clinikk reserves the right to change, modify or alter any of the terms and conditions and other policies applicable to the Health Card and the same will be notified on the website. The Card Holder is required to check and keep updated with the terms and conditions.
Clinikk reserves the right to change, amend, revoke, suspend, and/or terminate the subscription of any of the Card Holder for any reason that Clinikk deems fit without prior notice.
Any additional schemes, promotions, offers and discounts shall be governed as per their respective terms and conditions as may be notified in the website.
In the case of loss of the Health Card, a duplicate card may be availed by paying an additional cost and the duplicate card will have the validity of the original card.
The reward points of the duplicate Health Card will be the same as that of the original card.
The Rewards Point cannot be exchanged for cash or clubbed with other offers.
The Health Card will expire upon 1 year from the date of activation. Any unclaimed rewards will lapse upon expiry of the Health Card unless renewed.

The use of the services of this health Card shall be solely for the personal use of the Card Holder. This Health Card is valid for a period of 1 year from the date of its activation. The Health Card may be renewed by paying the subscription fees applicable at the time of renewal.
The Health Card holder is entitled for a host of benefits, offers, and discounts based on the Card Subscription Plan. The list of the benefits of the Card is available on the website. The subscriber can choose from a host of the benefits and offers applicable to them subject to availability. The benefits applicable to different cards may be subject to change from time to time at Clinikk’s discretion. Kindly check the website before availing any benefits, offers, and discounts.
The subscribers are entitled to certain rewards for successful referrals made. For details on the referrals and rewards policy kindly check Clinikk’s website.
If the Health Card Holder wishes to cancel or terminate his card, he may do so by calling Clinikk stating the reasons for such cancellation and the decision of Clinikk in this regard shall be final.
In the event that the Health Card is lost, a duplicate card may be obtained by paying fees of Rs. 100/- The validity of the duplicate card shall be the same as the original card.
Health Vault is a unique facility for storing and accessing all the health records of a patient. The Records contained in Health Vault includes:
User-Records- health records uploaded by the user into their account’s health vault
Health Buddy Record- The health records generated by the interaction with the medical practitioner/health care provider.
In addition to the other terms and conditions as mentioned in this Policy, the Health Vault

The Health Vault for any account is created only upon express consent of the user and only upon explicitly accepting the terms and conditions of Health Vault.
Any Health Buddy record created by the medical practitioner/health care provider shall be the sole responsibility of the medical practitioner/health care provider ad
Clinikk does not validate or authenticate the records generated by the medical practitioner/health care provider. In the event there are any discrepancies or doubts regarding the correctness of or any part of the record, you should directly contact the concerned medical practitioner/health care provider and update the same.
Clinikk is not responsible, directly or indirectly, for any content, information, prescription, protocol set, treatment, medical deductions or the language used in the records of your Health Vault. Your practitioner will be solely responsible for content/ information provided in your Health Vault.
You shall upload, share and transmit only health-related records and documents and no documents of any nature other than health-related records. If at any point of time, it is found that the records uploaded or shared are other than health related records, Clinikk reserves sole discretion to remove such records or suspend the account of the user with immediate effect without notice.
In case you wish to delete your health vault, you may do so by emailing to support@clinikk.com requesting the deletion of your health vault.
If any of the records are found to be uploaded or found to be shared incorrectly or inadvertently, Clinikk has sole discretion to retract such record.
By accepting these terms and conditions and creating Health Vault with Clinikk, you agree and acknowledge that Clinikk may have access to your health vault for technical and operational issues.
You agree and acknowledge that the access to your health vault may be given to the medical practitioner/health care provider for the purposes of providing you the reasoned and professional services.
Clinikk strives to maintain the highest level of service availability at all times. However, Clinikk is not liable for any inconvenience that may be caused by your access to the Health Vault records.
Clinikk uses best practices to ensure the security of your health records. However, Clinikk is not responsible for any unauthorized use or access if you lose your login credentials and account details. In case of loss of confidential and personalinformation or any breach of security of your account information, inform us by sending a mail to support@clinikk.com
You may choose to enable Health Vault facility for yourself and your dependents through your Clinikk account. In the event that you choose to access your dependents’ records through your account, then you are solely responsible for the health records of your dependents as if the dependents had uploaded and maintained the records themselves. You are deemed to have taken the consent of such dependents before uploading, share and host their records and other sensitive and personal information on the Health Vault. Clinikk disclaims all responsibility for any liability claim, loss, damage or dispute, due to the unauthorized use of your account and the records of your dependents.
Clinikk has partnered with Reliance for providing a Group Health Insurance product for its subscribers. Interested subscribers can apply for the Group Health Insurance by paying the relevant premium amount themselves or by availing a loan for same facilitated by Clinikk through its fintech partner. The key terms & conditions which are applicable for this product are as follows:
The product is completely optional and any subscribers might avail or not avail it at their discretion.
Interested subscribers can apply for this product by paying the premium amount directly or availing loan facility.
The decision of accepting any such application in the Group Health Insurance is completely with Religare and in case any application is rejected, then the entire amount paid by subscriber will be refunded.
The decision of sanctioning of loan of subscribers is completely at the discretion of our fintech partner and Clinikk will not be responsible in any way for any rejections.
The subscriber understands that the insurance cover is being given basis information disclosed by the subscriber. In case the subscriber gives any false information or does not disclose material facts, then the claims of such subscribers might get affected.
The subscriber understands and accepts that in case of any default in payment of the loan EMIs, then Clinikk will have the right to cancel the subscriber’s Clinikk subscription and the Group Insurance Policy and will use the refund received from Insurance company toward repayment of the loan. Any amount received in excess of the loan amount outstanding will be refunded to the subscriber.
In case of bounce of any Cheque or NACH given by subscriber, there will be bounce charge of Rs.500/-(including service tax).
Clinikk runs multiple rewards and cashback offers for it subscribers from time to time.
You can claim the rewards related to application installation only once.
You are not eligible for any cashback if you have uninstalled the application within a month of installing.
In all case of disputes, Clinikk Healthcare’s decision will be final.
